Consultation has concluded


Upper Hutt City Council is proposing to partially revoke the reserve status of part of the recreation reserve adjacent to 63 Black Beech Street, Birchville, Upper Hutt. The section that connects Black Beech Street to the Hutt River Trail will be unaffected. 




What’s happening?

Council is proposing to partially revoke the reserve status of part of the recreation reserve and sell it to the owner of 63 Black Beech Street. (The section that connects Black Beech Street to the River Trail will be unaffected).

The recreation reserve is ‘L’ shaped and connects Black Beech Street to the esplanade reserve which runs alongside the Hutt River and is part of the Hutt River Trail.

Approximately half of the reserve is a strip of land between the boundary of 63 Black Beech Street and the esplanade reserve.

The reserve revocation process is a statutory process as determined by the Reserves Act 1977, which requires public notification of the proposal to revoke reserve status.

Council is making this proposal on the basis that the reserve is currently occupied by the neighbouring property, which does not impact access to the trail.

We are seeking feedback on this proposal and would like to hear from you if you have any concerns.


Why is this happening?

In 1999, the property owner’s surveyor prepared a survey of 63 Black Beech Street to relocate a house from another site.

The plans incorrectly omitted the recreation reserve and located the house 12.15m from the adjacent esplanade reserve, rather than the recreation reserve.

Council consented to this and other building matters before the discrepancy in the boundary location was identified in 2005.

Council has been working with the property owner to resolve this issue and entered into an agreement to sell part of the recreation reserve, subject to revocation of its reserve status.
